Affidavit/questions by an Employment lawyer for validity of employment of felons/under qualified in to expose the fraud?
Plaintiff is alleging that a national firm employed couple of people with questionable adverse background and under qualified to execute couple of documents which are filed in government offices to commit fraud against the plaintiff.
Based on the crime records (State Crime database) and other educational qualification (from public websites which indicates one person is just a high school diploma), it is clear that these 2 individuals could NOT have been employed by that national firm. Especially in a very senior position as to execute very much legal documents that related to property ownership. In a earlier related trial, when the plaintiff requested to produce employment documentation, the defendants did not furnish those and the trial is stayed due to some other reason.
But in another subsequent trial at a another federal court, can plaintiff’s friend who is a State Bar registered Employment Lawyer, who can prepare or give an affidavit based on the crime data (which is 100% true) and the educational data(from public websites which may or may not be true) and file that and question the employability of such persons and seek the dismissal of the firms claim or not?
