A few months ago a credit card was taken out in my name. I just found out it was my spouse that opened the account.

A few months ago a credit card was taken out in my name and was used to withdraw about $300 cash. I just found out it was my spouse that opened the account. Can she be prosecuted? Can I press charges against her?

Yes and yes. She has clearly defrauded you and stolen your identity. It does not matter whether she is your spouse or not, you can press charges. The real question, is that what you want to do? This could make things ugly in a divorce that may occur afterwards, talk to her and figure things out before you start spending a fortune on lawyers.
