Can charges be filed by the police even if the victim chooses not to?

if someones credit card was used to make an online purchase and the card did not belong to the person that made the purchase….can the police file charges even if the card holder decided not to? since the purchase was online and nothing was signed for could the charge be identity theft? or just credit card theft or credit card fraud?

The police could always charge you but this question appears to demonstrate that no evidence has been presented to the police. This case would be hard to try without the testimony of the person who owned the card and for all anyone knows, they gave you permission.
