How to fight a traffic ticket that is missing information and filled out incorrectly?
I’m a CDL driver that was driving a CMV through the town of Hawthorne, NV when I got pulled over by a sheriff for supposedly doing 55 mph in a 40 mph zone, the officer cited me for 50 mph.
The officer filled out the ticket and handed it to me, and it has a lot of errors on it that I was hoping I could get advice on.
Here are the errors:
1) I was heading north on US-95 Bypass North and the Direction the officer put was “S”, even though I have proof I was going North towards Reno, NV.
2) No case # was filled in.
3) Vehicle information missing or incorrect.
a) Make: Infiniti — I was driving an International Semi, not a Infiniti sports car.
b) Model, Color, Type, Lic Plate, Veh Yr, DOT #: Missing, not filled in.
c) Comm Veh: No — I was driving a Commercial Vehicle however — it’s hard to miss that when it’s a 53′ dryvan with a huge company in NV logo on the side.
He put he paced me even though he was pacing the other truck I had passed, as he sped up after I passed him, he was doing 30-35mph when I passed him then sped up to 43mph according to the sherrif.
Is there anyway to get this dismissed by the judge?
