When my employer doesn’t pay me on time, where do I go?
I live in Lincoln, Nebraska and had some questions on the way my employer was paying me. I have about 4 months worth of stubs as well for proof. The “pay period start/end date” is always the 1st and the 15th, but the “check deposit date” is different. I understood this might be normal and didn’t think much of it until I moved out. Now that I follow my money closely; I’m 20 years old and a student with bills. My employer does not deposit my check via direct deposit until either the 4th, 5th, 6th, sometimes 7th or 8th, and at the end of the month will not pay me until the 22nd, 23rd, or even the 24th, 25th or 26th. It is usually 17-20 days in between each pay check, which seems illegal in itself. When I asked them about this, they said that it was the banks fault. When I went to the bank, they said they deposit the checks they receive right away, which made more sense than a bank holding onto a check for four or five days. Also, according to Nebraska Statutue 48-1230, employers MUST give a written notice at least 30 days prior to changing payday. What should I do? I want to go to the NE department of labor, but I want to make sure that I’m not blowing things out of proportion.

If this is a major issue for you, contact the department of labor in NE and have your employer investigated. This is the best route for you and you will remain protected from retaliation.
